Many criminals that are guilty of offense roam about the town just because sufficient evidence could not be produced at the trial. The exclusionary rule is in the US but not in the UK. Although the exclusionary rule says, â€Å"no object may be used in court as evidence if obtained illegally or without a proper search warrant† (Oracle ThinkQuest, n.d.). yet jury in the US hardly gets a cop convicted of obtaining the evidence by illegal means. Therefore, the English way does not suit the US. Nevertheless, I personally am against the exclusionary rule and appreciate the way cases are handled in the UK. It is hard to see a criminal moving around free when we are sure he/she did the offense.

A Jury of Her Peers free essay sample

â€Å"A Jury of Her Peers† by Susan Glaspell is a short story that examines how women who have similar backgrounds and common experiences enable them to identify with each other and piece together a murder without the help of men. The author wrote this story in the early 1900s when roles were still very divided between men and women. New inventions were emerging like the telephone and automobile however in rural areas of the United States these modern inventions along with the modern ideas of equality between men and women were still very much dismissed. Men were in charge of working the land and being the breadwinners and women remained in the home cooking, cleaning, and sewing. Women who were farmer wives were isolated as their work took up most of their day. There was no time for socializing and meeting for tea. This shared oppression of women helped women to sympathize with each other and clearly understand each other’s challenges, even if the women had never met. This short story illustrates just that as the two main characters Mrs. Hale and Mrs. Peters, who by working together find and destroy the clues in order to protect one of their own, Minnie Foster Wright and allow the men to never learn of the reasons behind the murder of John Wright. Susan Glaspell writes this story in third person omniscient. Through the use of this point of view, the narrator is able to illustrate a central point of view by showing each character’s thoughts, feelings and actions. In the first part of the story we learn about Mrs. Hale. She is an older women who has know Minnie for several years, however hasn’t seen her or kept in touch with her for years. Martha Hale has some guilt about not visiting Minnie ever, especially now that Minnie is accused of murdering her husband. We learn through the narrator that Martha â€Å"had a moment of feeling that she couldn’t cross it† in regards to the threshold to the Wright home because she hadn’t come before, but only now after this tragedy occurred. The reader understands through this literary point of view more about the character and her feelings. We also learn through Martha’s thoughts that Minnie was once a vibrant, well-dressed woman who sang in the church choir. â€Å"She used to wear pretty clothes and be lively—when she was Minnie Foster, one of the town girls, singing in the choir. † We also learn a lot about Mrs. Peters, the sheriff’s wife. Mrs. Peters is younger and never has met Minnie. We also get the idea through the narrator that Mrs. Peters is still very loyal to her husband and obedient. The county attorney states, â€Å"Of course, Mrs. Peters is one of us† in order to remind her of her obligation to the law and her husband. Martha and Mrs. Peters are the two main characters of the story, different ages and slightly different points of view however throughout the story they each individually begin to identify with aspects in Minnie’s life and they both agree to support Minnie and destroy the condemning evidence. Using third person omniscient is that the narrator is also able to focus the reader on specific scenes throughout the story so that the reader is able to understand what is important to the author. The Wright’s family house is located in a deep hollow. It is isolated from the town. It is cold and unwelcoming. The majority of the story happens mainly in the Wright’s kitchen, the main area for the homemaker, the women of the house. It is this part of the house that the all women spend the majority of their days, where all their hard work and toil occurs. The sheriff looks around the kitchen and states, â€Å"Nothing here but kitchen things,† when asked by the country attorney if they should focus their search in that room. The women in this story take offense quietly to such a comment, for they understand just how hard it is to be a wife of a farmer and maintain the home. Minnie’s kitchen is untidy with evidence of a job interrupted. The women notice and understand that no women would leave their kitchen in such disarray unless something interrupted their work. The women also are offended by the county attorney’s comment, â€Å"Dirty towels, not much of a housekeeper, would you say ladies? † Both Martha and Mrs. Peters understand that both the man and the women are responsible for making the house dirty. Mrs. Hale responds, â€Å"There is a great deal of work to be done on a farm,† which shows her growing empathy for Minnie. The women remain in the kitchen, the main setting of this short story as the men go off upstairs to the scene of the murder and out to the barn in search of clues to a motive for this crime. The author never takes the reader to these locations. The reader is never informed of what happens with the men on their search, instead we are focused on the women and the kitchen, as this is how the author illustrates the main theme of this story. Symbolism is also used effectively throughout this story in order for the reader to clearly understand Minnie’s life and motive of her crime. The torn clothing the women collect to bring Minnie in jail give us an understanding of why Minnie remained so isolated these last 20 years. The torn and repaired clothing symbolize Minnie’s esteem throughout the years. She was broken down over and over again by her husband and time and time again able to pick herself up and repair the damage although never completely. Just like the skirt she had endured abuse and although repaired, she would never be the same person she once was. Mrs. Hale comments that Minnie â€Å"most likely didn’t enjoy much feeling so shabby. † The reader starts to learn that Minnie was a sad and lonely woman and we see again how Mrs. Peters and Mrs. Hale feel a strong bond with Minnie and the sad life she led. The quilt the women discover in the kitchen is another very strong symbol. The majority of the quilt was neatly stitched, as a quilt should be, however Mrs. Peter’s notice one square that is sewed chaotically and out of order. It is a stark contrast to the other neatly sewn blocks. The perfectly stitched squares represent Minnie being a dutiful wife. She is doing as she is supposed to do as a woman in the early 1900s, maintaining the home, putting up with an unkind husband and keeping quiet. The crazy stitches however show us that she has had enough of putting up with her horrible life. She is stitching erratically and angrily displaying her frustrations and clearly deciding to take matters into her own hands. To support the theme of the story, Mrs.  Hale quickly removes the erratic stitching and begins to fix it so none one else may pick up on its meaning. The men return to the kitchen and comment that the women are worried about a quilt while they search for real clues. Again through these symbols readers see how the two women deeply empathize with Minnie and are determined to not let the overly objective men become aware of Minnie’s motivation for killing her husband. The most important symbol in this story is the canary, found dead, tucked neatly and delicately away wrapped in silk in Minnie’s sewing box. The canary represents Minnie. Minnie once sang in the church choir. She flitted about town in her younger years. She wore brightly colored clothing and was quite attractive. Mrs. Hale comments, â€Å"She, come to think of it, she was kind of like a bird herself. Real sweet and pretty, but kind of timid and fluttery. How she did change. † Twenty years later Minnie was a much different woman. She was lonely and married to a cold and uncaring man. They had no children and the canary was Minnie’s only companion on her long days in the kitchen. The canary provided a brightness and warmth to her life. Mrs. Hale and Mrs. Peters find the canary with its wrung neck their eyes meet and immediately the two women form a shared understanding of the horrible act that must of happened. It is now clear to the reader that the two women believe that John Wright has killed the canary, just like he has killed Minnie’s spirit. It is that moment when both Mrs. Hale and Mrs. Peters decide to conceal all their evidence against Minnie, for they truly identify and understand her actions. Symbolism, setting and the literary point of view all help Susan Glaspell tell her story of Minnie and John Wright. Through the various elements of literature used the reader is able to clearly identify with the author’s point of view. We are able to understand the main theme of the story, that due to men’s overt objectivity and ability to only look at things from a set of assumptions of what most people constitute as a crime along with their blatant disregard for women and their point of view they miss all the clues to a motive that they are searching for. The women are able to deeply identify with each other through shared life experiences. They understand how hard it is to be a women and wife in society. It is within this emotional connection that they are able to put themselves in Minnie’s shoes and understand her motivations. The worst aspect of attention deficit disorder, I have discovered, is that it takes away any self reliance. I can practice all night for a piano performance, but the next day I can only stare blankly at the smooth white keys that mock me with their composure. If I study for weeks for a test, I will walk into that class not remembering any information. I can ride a course, over and over again, in my mind, knowing what must be done at every stride. Yet, when it comes to actually riding it, my mind works against me. Where is the next fence? What was I supposed to do at this corner? I have learned not to rely on myself and in doing so, unfortunately I have taught others to do the same. Parties, birthdays, and plans made last month will most likely be forgotten until it is too late, or, never remembered. My best friends especially know this and joke, â€Å"Don’t bother telling Chelsey, her ADD usually kicks in right about now.† This does not bother me, but when I actually l et them down I feel ashamed, embarrassed, and humiliated. Contrary to my â€Å"disorder,† as my parents refer to it as, I am known among friends as the one to go to for advice. Anything from schoolwork to money to relationships, I seem to hold the golden key of solution for all. All, that is, except myself. For example, my sophomore year of high school, I was doing well in comparison to my friends in geometry. As the final exam loomed upon us, I offered to tutor a few friends who needed a boost. As a result, each and every one of those friends scored higher than I did on the exam. This makes me known as the â€Å"nice person,† according to my two best friends. People who I hardly know rely on me as a back up to borrow books, money, or advice. While this should make me proud, it actually irritates me. I realize I have no one to rely on. With my so-called â€Å"disorder† comes another negative in my life; anxiety. Anxiety, I believe, is one of the worst aspects of being myself. It prevents a normal sleep pattern, and refuses to let me enjoy anything to the fullest. While watching a movie, reading a book, or socializing, there is always something there, nagging at me. Telling me I will not forget. A test? A forgotten assignment? All I know is that sometimes I cannot eat, sleep, or even function correctly until I know what it is and have completed it. The problem is, by then, there is already something else there. When I get especially anxious over something, my speech impediment tends to appear. When I was younger I never spoke; my sister always spoke for me. It took me nearly three years with a speech tutor, but now I have perfect pronunciation, as long as I do not get too stressed out. Attending the only private school in Stockton, I am grateful for being sheltered from dangerous activity caused by gang violence. However, public schools, by law, must give accommodations to students with disorders. I struggled through until the end of my sophomore year, when I was diagnosed. My school told me that it was ultimately the teachers’ decision regarding accommodations; a few teachers gave me private tests with extended time, but most did nothing. One teacher, who taught psychology, told me ADD does not exist. Though my prime struggle has been ADD, I have dealt with many others. One of which was my grandmother’s death. She was the largest inspiration on my life. The summer before I started high school, she was diagnosed with pancreatic cancer. I was left alone to cope with grief, my mother was distraught, my father busy with work, and my sister was in Europe. I realize now that I grew up that summer much more than I should have. Watching her die was one of the most traumatic things I have ever witnessed, and I will not ever forget it. The memories I hold of her are strong and plentiful. But I know that one day I may forget. The sight of her working with the horses, or yelling at us on Sunday mornings to get ready for mass are ones that may, with time, fade from my mind. I listen to friends complain about having to do chores for their grandparents and I think they know not how rare it is to have grandparents at our age. I wish she was here now to help guide me in the right direction. I realize I need her more now than I did then. How could I possibly choose a college or a career without her input? Although I know she is guiding me from above, I can only pray its strong enough to point me in the right direction. I know I make mistakes just like everyone else, but every time I do, I feel guilty that that is what she sees of me now. She always encouraged me to do my best, and to be as perfect as possible. I hope that I am meeting expectations.

In the few movies that were based around women, the womans character was written by a man, and the woman was portrayed as a sex symbol. In the movie Double Indemnity, a woman named Phillis is plotting to have her husband killed because she wants to collect his life insurance and be freed from an unhappy marriage. She uses her sexuality and good looks to convince Walter Neff to help her in her scheme. In this movie, Phillis is a beautiful, sexy, conniving killer. In the end, however, because she does not have the heart to kill her husband, the audience is supposed to redeem her conniving image. In the 1940s movie Gilda, the women has two different stereotypes. The first stereotype is a beautiful sex goddess. She is so beautiful that any man would love to be with her. The second stereotype parterres her as a scorned women. Prehistoric Art - Essay Example During 1940, four teenagers discovered the wealth of artistry within these caves (Lascaux 2007). According to Cornwell, "the cave was evidently a sanctuary for the performance of sacred rites and ceremonies." Lascaux contains the earliest traces of man's civilizations and holds the key in unlocking the prehistoric period. To date, it is estimated that the paintings on its walls totals around 20, 000. The caves feature realistic images of large animals which are believed to have thrived within the area thousands of years ago. The largest portion of the paintings is identified to be animals like horses, stags, cattle, and bison, while there are also drawings of geometric figures. Non-figurative images are speculated by one researcher to be illustrations of the night sky as the painted dots correlate with various constellations (Lascaux 2007). Aside from the illustrations of animals which thrived during the period, Lascaux is also said to house the "one of the humanity's earliest narrative compositions" (Virtual Realities n.d.). The writer described this particular scene: "Almost cartoonlike in appearance, it shows a man with the face (or mask) of a bird, engaged with an apparently fatal disagreement with a wounded bison. As the bison uses its head and horns as a weapon, the man falls stiffly back, apparently to his death" (Virtual Realities n.d.) Thus, Lascaux does not only depict the different players in the early civilization but expresses stories which have not been put in words by ancient man. The Altamira in Spain is another famous haven for prehistoric art. Like the Lascaux, Altamira is a cave which features drawings and polychrome rock paintings of wild animals and human hands. Because of its perceived importance in understanding the civilization of man, the UNESCO declared Altamira as a World Heritage Site (Altamira 2007). The 270 meter cave is comprised of twisting passages and chambers. The formation of the cave is due to the "collapses following early karstic phenomena in calcerous rock of Mount Vispieres" (Altamira Cave n.d.). Excavations on the site reveal two levels of archeological levels; one belongs to the Solutrean and the other to the Magdalenian. The Solutrean culture is said to have been formed from the occupation in the cave around 18, 500 years ago. Aside from the paintings, artifacts have also been excavated from this civilization. The Magdalenian period dates back 15, 500 and 14, 000 years ago (Altamira Cave n.d.). The most famous of area in the cave is known as the Ceiling of the Polychromes. This features superimposed paintings and engravings the most prominent of which shows herd of bison in different poses, two horses, a large doe and a possible wild boar (Altamira 2007). Peace and Conflict Essay While the term conflict generally is associated with negative encounters, conflict itself is neither inherently good nor inherently bad. In fact, engaging in conflict can have positive effects on relationships and organizations. Conflict among people, institutions, organizations, nations and in all relationships are a normal, natural and inevitable part of life. In itself, it is to a great extent a necessary tool that enhances development and can be regarded as normal and a prerequisite under certain conditions. In view if this, this paper will labor to clearly examine the conditions in which peace is said to be a normal phenomenon. The term conflict will exhaustively be defined from different school of thoughts and its kinds or types outlined, followed by cited conditions that advocate for the presence of conflict as being normal. Thereafter, a comprehensive conclusion will be drawn from the entire discussion. Conflict can be defined in many ways and can be considered as an expression of hostility, negative attitudes, antagonism, aggression rivalry and misunderstanding. It is associated with situation that involve contradictory or irreconcilable interests between two opposing groups. The term conflict is derived from a Latin word that means to clash or engage in a fight. It is a confrontation between one or more parties aspiring towards incompatible means or ends, Miller (2005). ‘’Conflict is a multi-dimensional social phenomenon which is an integral feature of human existence, essential to the ongoing processes of history, to social change, and transformation,’’ International Alert et al. 1996, 3). Swanstrom and Weissmann (2005) define conflict as being the result of opposing interests involving scarce resources, goal divergence and frustration. This is outside the traditional military sphere and is based on behavioral dimensions. The process begins when one party perceives that another party has negatively affected, or is about to negatively affect, something that the first party holds in great esteem or importance. In the same sense three forms of conflict have been identified. This implies that it has levels to influence namely; Interstate, which is the disputes between nation-states or the violation of the state systems of alliance; Internal conflict, is type of dispute that happens within a given society or part of the given society such as territorial disputes, and civil and ethnic wars; and State-formation, this is the battles over control of government. These are internationally recognized as challenges, which to some extent have been classified as a normal phenomenon as people are heterogeneous in their interests and desires, Wallensteen (2002). Differences in interpretation of the conflict result from different orientations in an effort to resolve and overcome conflicts. One thing that different approaches agree on is that conflicts are essentially clashes among people. These clashes arise from differences of values and interests of opposing parties, those parties being individuals, groups or entire organizations, (Adler, 2002). Conflict also has a positive dimension as normal forms of social interaction which may contribute to the maintenance, development, change and overall stability of social entities. Many social scientists hold that periods of change, be it economic growth or decline, political transitions, or social innovation are associated with conflict. A Dutch scholar by the name of Bonger, believed that theirs is a causal link between conflict and economic and social conditions. Existing institutions come under pressure and may be unable to control or integrate new forces, demands, and collective actors. Change is likely to be uneven and to create a sense of relative deprivation, injustice, and threat among the losers. A recent example is the pressure mounted on the government of Chad in ensuring there is proper accounting procedures in the management of the country’s oil revenue. The activities of these organizations have been both positive and negative. From the positive side, they have been able to curb some of the excesses of governments in many developing countries, (African Centre for the Constructive Resolution of Disputes [ACCORD], 2008). Traditional human rights theories seldom took conflict theories to exam the conflicts between different rights and social movements. Under conditions that human rights are violated or a particular class in society feels their rights are not fully being exercised, conflict can be seen as a normal phenomenon. In 1997, the Taiwan feminism movement was separated by the sex worker’s issue. The major feminism groups denied sex could be seen as a right to work, but more tended to see it as a product by exploitation. To those support sex workers, they addressed sex workers have their rights to use sex or body as a work, and even further claimed that sex work is a radical sexual movement, (Ho, 2005). In such a situation, conflict is normal and beneficial as it acts as a podium of debate and its advantages of fostering an awareness of problems that exist and leading to better solutions is clearly seen. Above all the norms of society are readjusted. The more diversified and heterogeneous a society becomes, the greater the probability of more frequent conflict as subgroups who live by their own rules break the rules of other groups (Best, 2004). Conflict is a natural part of relationships. While relationships are sometimes calm and predictable, at other times events and circumstances generate tensions and instability. This phrase suggests that life gives us conflict, and that conflict is a natural part of human experience and relationships. Rather than viewing conflict as a threat, the transformative view sees conflict as a valuable opportunity to grow and increases our understanding of others and ourselves. Conflict helps us stop, assess and take notice. South Africa for example has a multiracial and multiethnic population. â€Å"Blacks constitute 77% of which the Zulu make up 22. % of the overall population,† (ACCORD, 2008, 15). The liberation struggle during the years of white minority rule cemented the Blacks, Asians and coloured people together. The unity forged by the blacks, Asians and colored people under white oppression collapsed when state power was to be competed for by all groups. The conflict of power here is seen as a means of uniting these different groups for the purpose of achieving a common goal, (ibid, 2008). Furthermore, conflicts with some groups bring about fraternity. It maintains and revises the balance of power among antagonists. When conflict breaks out, the former accommodation between the parties involved is rejected, the relative war of each group is tested and a new equilibrium can be established. Such arrangements in the balance of power thwart any one group from being dominant over other groups. As long as their power is continually challenged, members of the ruling group will be blocked from exclusive control of the social system. In most African states where the fight for independence was intense, most ethnic groups worked together to secure independence. Conflict continually creates new norms and modifies old ones. It bringing about situations to which the usual rules do not apply, conflict stimulates the establishment of appropriate guides to action. Moreover, the threat of attack, preparation for war or any hostile challenge from outside can strengthen a group’s solidarity and cohesiveness (Galtung, 1990). Conflict within and between social groups disturbs habits of thought and behavior and creates an atmosphere for innovation and creativity. This is another positive attribute of conflict that can be regarded as normal is that it facilitates the ovement or flow of one generation to the next. This is achieved in that society evolves over a period of time as values and norms of people continue to class and oppose each other within society. The changes may be positive hence benefiting humanity at large though in most cases these benefits are unanticipated and long-term. Finally, Weber contended that it will always exist, regardless of the social, economic, or political nature of society, and that it was functional because of its role in bringing disputes into the open for public debate. Even though individuals and groups enjoying great wealth, prestige, and power have the resources necessary to impose their values on others with fewer resources, Weber viewed the various class divisions in society as normal, inevitable, and acceptable (Curran Renzetti, 2001). However, it must be noted that if conflict is not managed, it pauses a great danger to humanity. If conflict is to be accepted as a normal phenomenon, it has to be managed or resolved quicker and more efficiently than letting it fester. For Mial and Wood House (2001), by conflict resolution, it is expected that the deep rooted sources of conflict are addressed and resolved, and behavior is no longer violent, nor are attitude hostile any longer, while structure of the conflict has been changed. Desmond Tutu, the Anglican Archbishop emeritus of South Africa, is reported to have commented from within the situation of social revolution in South Africa that â€Å"without reconciliation, there is no future† (Wustenberg, 1998, 5). It is therefore now right to conclude that peace is a normal phenomenon but not when it is poorly managed or resolved. Issues such as the rearrangement of the balance of power, readjustment of group norms and the maintenance of group unity have been examined as the product of conflict even though conflict can be destructive in nature. Contemporary understanding of conflict represents a belief that conflict is not only a positive force of one group, but it is also absolutely essential for achievement of the efficiency of the group.

Racism: The Artificial Category of Race THESIS: Scientists and other intellectuals recognize the modern concept of "race" as an artificial category that developed over the past five centuries due to encounters with non-European people. Even though people still attempt to organize humans into categories according to their race, these categories have been shown to have no scientific basis. The term "race" is a modern concept. It's definition has adopted radically new meaning over the past few centuries. Currently, the term is used to characterize differences among human groups. According to the Oxford English Dictionary the term "race" in 1512 is "a group or class of persons, animals, or things, having some common feature or features." Today, Oxford's definition is quite different: "a local geographic or global human population distinguished by genetically transmitted characteristics and/or any of the major biological definitions of man distinguished by physically evident features, for example, Caucasian, Negroid, and Mongoloid." This definition is a result of regular interaction with non-European people. The Europeans began to explore other lands, thus creating the idea that some people are different than them and should not be under the same category as them. The constant interaction with groups of people who’s lifestyles were very different led Europeans to believe that they were a different "kind" of people. Scientists worked on and created many different ways to classify the different people they found. This unrefined method of categorization was the origin of a new culture-oriented taxonomic system for human beings. The beer industry is incredibly large industry that has an enormous effect on the country, contributing greatly to the society. Two of its main contributions include tax dollars and jobs. The beer industry serves the country through its taxes, jobs, and purchases from other suppliers, its contribution to agriculture and more. After 1990’s some of the leaders started expanding abroad, using progressive consolidation and leading to a small number of global players in the industry by 2004-2007. Which created high level of competition amongst the leading brands and a fight to gain the most market share. The Scope of competitive rivalry is also one the best way to identify the economic characteristics of any industry; with the beer industry the scope entails the global geographic area over which most of the leading brewing leaders compete. Penetration in the foreign market arena is becoming a key success indicator for most of the competitors in the beer industry. Use of high-speed packaging line helps in processing thousands of cases of beer per day, and with modern computerized control, the inventory can be tracked throughout the distribution network. These inventions are setting a faster pace of technological change in the industry, where by companies are delving into extensive research, and employing highly qualified personnel in order to beat the competition. To comprehensively examine the brewing industry we must also consider the factors of social ramifications to the product, the political climate, and the arena of technological advances within the business environment of the beer industry. Over the years in order to gain economies of scale some leaders have tried to increase the size of their plants, improve packaging and introduce automated breweries, thus reflecting few of the business characteristics dominant in the industry. Grupo Modelo for example tried to expand into the American beer market by the use of competitive distribution channels. Therefore indicating an economical ripple effect experienced through the effective use of technology and distribution channels in hand.

The American Revolution was the struggle by which thirteen colonies won independence from Great Britain, to become what we now know as The United States of America. The American Revolution came about primarily because the colonists had matured. Their interests and goals were so different and distant from those of the mother country. Local politics, practices, social customs, religious beliefs, and economic interests had gone so far from the English ways. The American Revolution had a tremendous impact not only in The United States, but also in Europe and the rest of the world. The Navigation Acts channeled the flow of colonial raw materials into England and kept foreign goods and vessels out of colonial ports. The Navigation Acts incorporated multiple laws that were created over a period of time. The Acts were passed with the theory of mercantilism, which restricted free trade. They were intended to keep foreign goods and vessels out of colonial ports. The Navigation Act of 1651 banned imported goods from other countries, unless the ship or cargo had an all-British crew. The second Act was extended to exports in addition to imports. Four more Acts were passed between the years of 1662 and 1773, which proposed even more restrictions on trade. The Molasses Act in 1773 forced the colonists to purchase the more expensive sugar from the Britain because they had raised the tax on all sugar and molasses products coming from anywhere else.
